Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the property management services provided by Amber Homes ("we," "us," or "our") to landlords ("you" or "Client"). By engaging our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you should not engage our services.

2. Services

Amber Homes provides property management services including, but not limited to:

  • Tenant placement and referencing
  • Rent collection and financial management
  • Property inspections and maintenance coordination
  • Compliance management (gas certificates, EPCs, etc.)
  • Tenant communications and dispute resolution
  • Guaranteed rent schemes (where applicable)

Specific services will be detailed in your individual Service Agreement.

3. Service Agreement

A written Service Agreement will be provided detailing:

  • Property details and agreed services
  • Management fees and payment terms
  • Contract duration and notice period
  • Responsibilities of both parties
  • Termination conditions

The Service Agreement, together with these Terms, constitutes the entire agreement between you and Amber Homes.

4. Landlord Obligations

As the landlord, you are responsible for:

  • Ensuring the property is legally compliant and fit for letting
  • Maintaining adequate property insurance
  • Providing necessary documentation (title deeds, certificates, etc.)
  • Approving major repairs and expenditure as outlined in the Service Agreement
  • Paying management fees and authorized expenses on time
  • Notifying us of any changes to your circumstances or property status

5. Fees and Payments

Management fees are specified in your Service Agreement and may include:

  • Monthly management fee (percentage of rent or fixed amount)
  • Tenant find fee (one-time charge for new tenancies)
  • Property inspection fees (if applicable)
  • Additional services as agreed

Fees are typically deducted from rental income before payment to you. We reserve the right to adjust fees annually with 60 days' written notice.

6. Guaranteed Rent Scheme

For properties enrolled in our guaranteed rent scheme:

  • We guarantee payment of agreed rent regardless of occupancy
  • We assume responsibility for void periods and tenant defaults
  • Minimum contract period typically applies (3-5 years)
  • Property must meet our standards and approval criteria
  • Rent reviews may occur annually as specified in the agreement

Specific terms for guaranteed rent will be detailed in your Service Agreement.

7. Maintenance and Repairs

We will coordinate necessary maintenance and repairs:

  • Emergency repairs will be authorized immediately to prevent property damage
  • Routine repairs under £200 will be authorized without prior approval (unless otherwise agreed)
  • Major repairs exceeding the agreed threshold require your authorization
  • We use trusted contractors and obtain competitive quotes
  • All repair costs are your responsibility (unless covered by guaranteed rent scheme)

8. Compliance and Legal Requirements

We assist with compliance, but ultimate responsibility remains with you:

  • Gas Safety Certificates (annual)
  • Electrical Installation Condition Reports (every 5 years)
  • Energy Performance Certificates (EPCs)
  • Smoke and carbon monoxide alarms
  • Right to Rent checks
  • Deposit protection compliance

We will track and arrange these certifications, but you are legally responsible for ensuring compliance.

9. Liability and Insurance

Amber Homes maintains professional indemnity insurance. However:

  • We are not liable for losses arising from tenant default (except under guaranteed rent)
  • We are not liable for property damage unless caused by our negligence
  • You must maintain adequate buildings and landlord insurance
  • We recommend landlord liability insurance
  • Our liability is limited to the amount of management fees paid in the preceding 12 months

10. Termination

Either party may terminate the Service Agreement:

  • By providing written notice as specified in the Service Agreement (typically 30-90 days)
  • Immediately if the other party commits a material breach
  • Immediately if the property is sold or becomes unavailable for letting

Upon termination, all outstanding fees and expenses must be settled. We will provide final accounts and transfer all relevant documentation and tenant deposits.

11. Client Money Protection

Amber Homes is a member of a Client Money Protection (CMP) scheme as required by law. Your rental income and tenant deposits are protected in accordance with legal requirements. Tenant deposits are protected in a government-approved tenancy deposit scheme.

12. Dispute Resolution

In the event of a dispute:

  • We will first attempt to resolve the matter through direct discussion
  • If unresolved, disputes may be referred to our membership body, Property Redress Scheme
  • You may also contact the Property Ombudsman for independent resolution

These Terms are governed by the laws of England and Wales.

13. Data Protection

We process your personal data in accordance with our Privacy Policy and UK data protection laws. Please refer to our Privacy Policy for detailed information about how we handle your data.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to you in writing with at least 30 days' notice. Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
